Since the epidemic outbreak, many foreigners have chosen to work in China, the premise is that a legal visa is required. With the recent advent of the double reduction policy, visa processing for foreign talent in China has also encountered unprecedented difficulties. Some provinces have to be more stringent for foreign talent and there is a risk of visa processing being denied. The success of an application for a foreigner work permit requires particular attention to two aspects:

【企業(yè)方面】
When recruiting foreign talent, employers must have a clear understanding of local visa processing policies and be clear about whether and what type of work visas can be issued to foreign talent for targeted recruitment.
用人單位在招聘外籍人才的時(shí)候,一定要清晰的了解當(dāng)?shù)氐暮炞C辦理政策,要明確是否可以給外籍人才辦理工簽,辦理什么類型的工簽,進(jìn)行有針對(duì)性的招聘。
1. The enterprise must be established in accordance with the law, have actual business premises, pay taxes in accordance with the law, pay social insurance and have no major illegal and untrustworthy records. Jobs employing foreigners with special needs must provide industrial permits in accordance with the law, and must not violate relevant national regulations. Wages for employing foreigners must not be lower than the local minimum wage, and legally employed foreigners are protected by labour laws.
1、企業(yè)必須是依法設(shè)立,有實(shí)際經(jīng)營(yíng)場(chǎng)所,依法納稅,繳納社會(huì)保險(xiǎn),無(wú)重大違法失信記錄。雇傭外國(guó)人的職位有特殊需求要依法提供行業(yè)許可,不得違反國(guó)家有關(guān)規(guī)定。雇傭外國(guó)人的工資不得低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn),合法就業(yè)的外國(guó)人得到勞動(dòng)法保護(hù)。
2. The laws and regulations shall be approved in advance by the competent industry department, and enterprises shall not declare indiscriminately, and shall not apply for work permits for foreigners who do not meet the conditions.
2、法律法規(guī)的規(guī)定由行業(yè)主管部門事先批準(zhǔn)的,應(yīng)當(dāng)經(jīng)批準(zhǔn),企業(yè)不能亂申報(bào),對(duì)于不符合條件的外國(guó)人,企業(yè)不得為其辦理工作許可。
[On the personal side]
【個(gè)人方面】
1. Foreign applicants must be at least 18 years of age, be in good health with no infectious diseases, have no criminal record in China or abroad, have a domestic identified employer, and have the professional skills or adapted level of knowledge required to perform the job.
1、外國(guó)申請(qǐng)人年齡需滿18歲以上,身體健康沒(méi)有傳染病,中國(guó)內(nèi)外沒(méi)有犯罪記錄,有國(guó)內(nèi)確定的用人單位,有從事該工作所需的專業(yè)技能或適應(yīng)的知識(shí)水平。
2. For general work, education must be at least a Bachelor's degree or above, and have 2 years or more of relevant work experience after graduation, in line with the development needs of our talent and labor market.
2、對(duì)于一般工作,學(xué)歷需達(dá)到本科(Bachelor)或以上,并具備畢業(yè)后2年或以上的相關(guān)工作經(jīng)驗(yàn),符合我國(guó)人才及勞動(dòng)市場(chǎng)的發(fā)展需求。
3. Where laws and regulations provide otherwise for foreigners coming to work in China, the provisions shall apply.
3、法律法規(guī)對(duì)外國(guó)人來(lái)中國(guó)工作另有規(guī)定的,從其規(guī)定。
